Sample Rules & Regulations
ELIGIBILITY: You must be 18 or older to participate. Only one (1) individual may be identified as the donor for each raffle ticket appreciation gift. All federal, state and local laws apply. You may donate safely and easily by charge or debit card on the secure Charity Raffle website. When your donation is confirmed, you may download your raffle ticket number immediately upon confirmation of the donation transaction. All email communications, including email ticket number confirmation, will be sent to the email address you supply during the donation transaction process. It is your responsibility to provide valid postal and email addresses in order to receive confirmation of your ticket number and to receive notification if you win a prize. Please remove any spam or system blocks that would prevent the successful delivery of an email confirmation. Your ticket number or numbers will be sent to you by postal mail if you request the Raffle Administrator to do so within ten days of making your donation. The raffle sponsor and its agents, vendors, volunteers and members assume no liability for lost or undeliverable raffle entries or for raffle entries deemed invalid as spam.
DRAWING The drawing will be conducted as follows: Winning numbers will be drawn by secure random computer selection on date xxxxx. All entries must be received by 11:59 p.m. , EST on date, to be eligible for the drawing. If all 10,000 raffle entry numbers are handed out prior to the drawing date, the drawing will be held within seven days after the last ticket number is given out. No paper ticket or confirmation number is required to claim a prize if the ticket was generated online and verified by email to the donor.
PRIZES: All prizes will be awarded on the drawing date. Prizes may not be exactly as shown, but will have a value equal to the prizes documented on the nporaffles website. The approximate total value of all prizes is $70,000.00, based on the price at the time of the prize selection. All tickets numbers are eligible to win each prize. If a winning number is claimed by more than one individual, the Raffle Administrator will award the prize to the name listed with that number in the ticket number database. The CAO is not responsible for resolving disputes or conflicting claims of ticket ownership.
The winner of the 1st, 2nd, and 3rd prizes may choose to accept the prize or the prize cash equivalent, as shown on the sponor's Raffle website. A car winner will be required to provide proof of insurance prior to taking possession of a vehicle and to pay vehicle delivery costs if the delivery is beyond the location of the dealer in the US nearest to their address.
NOTIFICATION OF WINNERS: Winners will be notified in writing by the sponsor within seven (7) days of the raffle drawing. Prizes, excluding vehicles, will be sent to the winner’s home address of record in the ticket database, unless otherwise requested by the winner in advance. The winners will have fourteen (14) calendar days from notification of winning, to inform the sponsor of their choice to take possession of the prize or to accept the cash equivalent. If no choice is made in 14 days, the Raffle Administrator will deem that the winner has chosen to take the cash equivalent. Winners are required to take delivery of a vehicle prize within forty-five (45) days after the drawing date and to claim all other prizes within sixty (60) days of the draw date if they do not take the cash equivalent.
Winners' names and locations will be posted on the sponsor's official website www.yourname.com. If the Raffle Administrator is unable to contact or locate a winner after a period of sixty (60) days from the draw date, a second drawing for the prize in question will be made. If after the second drawing, a winner cannot be contacted after a period of sixty (60) days, the prize will be deemed to have been donated to sponsor. Reasonable attempts to contact the winners shall be made to both the email and postal mail addresses of record in our database, and to the phone number provided by the donor. All winners, by accepting the appreciation gift of the raffle ticket, authorize the sponsor to publish their name and likeness on the website and to use them in other promotional materials.
TAXES AND IRS RULES: Winners shall be responsible for all federal, state and local taxes, fees, assessments and like charges due associated with acquiring a prize. Vehicle winners shall be responsible for paying state or local license,
title, and registration fees and insurance costs associated with accepting and operating the vehicle. Cash prizes will be paid to the winner minus income tax withholding if required by law.
SPECIAL NOTE: The IRS requires that income tax withholding be made on prize values of $5,100 or greater. That withholding cost must be paid by the sponsor before distribution is made to the winner. Government rules governing withholding can change without notice, and the sponsor will follow the rules and laws in effect at the time the prizes are awarded. The IRS has taken the position that donations to charities that involve a raffle are not gifts, and therefore, the donation does not qualify as a deductible charitable contribution. Check with your qualified financial advisor for additional information.
WAIVER/LIMITATIONS OF LIABILITY: By accepting the raffle ticket appreciation gift, donors (and winners, by accepting a prize) release the sponsor and its respective members, partners, vendors, agents, representatives, sponsors, service agencies and independent contractors, and each of their respective directors, officers, partners, employees and agents, including advertising and promotion agencies, from any and all liability with respect to participation in the promotion of and/or possession or use of the prize(s) awarded and also acknowledge that they did not receive any representations, warranty or guarantee, express or implied, in fact or in law, relative to any prize, including but not limited to its quality, mechanical condition or fitness for use. In the case of any dispute, the decision of the Raffle Administrator is final.
FINANCIAL: If the Raffle does not receive enough revenue to pay operating and prize costs by the published draw date, the sponsor reserves the right to extend the prize drawing date for thirty days. If at the end of the extension period, donation revenue is still not sufficient to pay the expenses and prize cost, the Raffle Administrator Administrator will conduct a drawing and divide the raffle net revenue (revenue – expenses) 50/50 with the First Prize Winner.
